Terms of Service

By accessing, registering for, or using Simlancer, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

If you do not agree with any part of these Terms, you must immediately stop using the Platform. Your continued use of Simlancer after any modification to these Terms constitutes your acceptance of the updated version.

Simlancer reserves the right to update, modify, or replace any part of these Terms at any time. Material changes will be communicated via a notice on the Platform. It is your responsibility to review these Terms periodically.

Simlancer is a listing and discovery directory. We provide a space where Second Life content creators, builders, scripters, and other service providers can advertise their services, and where interested parties can discover them.

Simlancer does not act as a broker, agent, escrow, or intermediary of any kind. We do not process payments, hold funds, mediate disputes, negotiate contracts, or guarantee the performance of any service or project posted on the Platform.

All transactions, agreements, negotiations, and payments occur exclusively and directly between the Freelancer and the Client, inside or outside of Second Life. Simlancer is not a party to any such arrangement under any circumstances.

Simlancer is an independent platform and is not affiliated with, endorsed by, or sponsored by Linden Lab or Second Life. Second Life and Linden Lab are trademarks of their respective owners.

To create an account on Simlancer, you must possess an active, valid Second Life avatar. Registration requires verification via your Second Life avatar name through our in-world verification system.

By registering, you agree that:

• You are the legitimate owner of the Second Life avatar used during registration.
• All information you provide is accurate, current, and truthful.
• You will maintain the accuracy of your account information at all times.
• You will keep your password confidential and not share access to your account with others.
• You are solely responsible for all activities that occur under your account.
• You will not create multiple accounts to circumvent a ban or any platform restriction.

Simlancer reserves the right to reject, suspend, or permanently terminate any account at its sole discretion, with or without notice, for any violation of these Terms or for any behavior deemed harmful to the Platform or its community.

This is one of the most important sections of these Terms. Please read it carefully.

Simlancer bears absolutely no responsibility for any financial loss, fraud, non-delivery of services, poor quality work, disputes, scams, or any other harm resulting from interactions, agreements, or transactions between users — whether conducted through the Platform or outside of it.

Because Simlancer does not process or handle any payments, does not hold funds in escrow, and does not verify the skills, identity, or trustworthiness of any user beyond the Second Life avatar verification, you acknowledge that:

• You transact with other users entirely at your own risk.
• Simlancer has no ability to recover lost Linden dollars or any other form of payment on your behalf.
• Simlancer cannot intervene in, arbitrate, or resolve disputes between users.
• Reporting a user to Simlancer does not constitute a legal complaint and does not guarantee any specific action.
• Listing a service or project on Simlancer does not constitute any warranty or guarantee by Simlancer regarding its quality or legitimacy.

Users are strongly encouraged to perform their own due diligence before engaging with any freelancer or client — including checking their reviews, ratings, portfolio, and reputation within the Second Life community.

The following are strictly forbidden on Simlancer. Violations may result in immediate and permanent account ban with no prior warning:

5.1 — Adult & Explicit Content

• Nudity or sexually explicit content of any kind, including partial nudity when presented in a sexual context.
• Advertising, offering, or soliciting adult services, escort services, or any sexualized engagement.
• Uploading avatar images, portfolio photos, or service thumbnails that contain explicit material.

5.2 — Hate Speech & Discrimination

• Content that promotes, glorifies, or incites hatred, violence, or discrimination based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other characteristic.
• Racist, xenophobic, antisemitic, homophobic, transphobic, or otherwise bigoted language, symbols, or imagery.
• Dehumanizing comparisons or slurs targeting individuals or groups.

5.3 — Offensive Language

• Gratuitous profanity, insults, or aggressive language directed at other users in any public area of the Platform (profiles, service descriptions, project descriptions, comments).
• Harassment, threats, intimidation, or targeted abuse toward any user.
• Doxxing — publishing or threatening to publish private personal information of another user.

5.4 — Fraudulent & Deceptive Behavior

• Knowingly advertising services you cannot or do not intend to deliver.
• Impersonating another Second Life avatar, real person, or Simlancer staff.
• Posting fake reviews or manipulating the ratings system.
• Using the Platform to facilitate fraud, scamming, or any scheme designed to deceive other users.
• Creating duplicate accounts to evade a ban or platform restrictions.

5.5 — Illegal & Policy-Violating Content

• Any content that violates applicable laws or Linden Lab's Second Life Terms of Service.
• Advertising services related to gambling, money laundering, account hacking, or any illegal activity in or outside of Second Life.
• Distributing malware, viruses, or malicious code through any part of the Platform.
• Using automated bots or scrapers to access the Platform without prior written consent.
• Copying, reselling, or claiming ownership of another creator's Second Life content without authorization.

Users may publish service listings and project requests on Simlancer subject to the following conditions:

• Listings must accurately describe what is being offered or requested. Misleading titles, descriptions, or pricing are prohibited.
• Prices must be stated in Linden dollars (L$) where applicable. Pricing listed on Simlancer is informational only and does not bind any party to a final transaction.
• Users must have the right to offer the services they list. Selling or claiming credit for another person's Second Life creations is strictly forbidden.
• Services or projects related to prohibited content (as defined in Section 5) will be removed and may result in account suspension.
• Simlancer reserves the right to remove, edit, or restrict any listing at its sole discretion without prior notice.

Simlancer does not verify the actual capacity, credentials, or in-world reputation of any Freelancer. Users are responsible for vetting prospective collaborators independently.

Users may leave reviews, ratings, and comments on profiles and service listings. By submitting any content on Simlancer, you grant Simlancer a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content within the Platform.

• Reviews must reflect a genuine, first-hand experience. Review manipulation (trading reviews, incentivizing reviews, or submitting fake reviews) is prohibited.
• Comments must remain civil and on-topic. Harassment or abusive language in comments will result in their removal and may lead to account suspension.
• You retain ownership of content you submit, but you are solely responsible for ensuring it complies with these Terms and applicable laws.
• Simlancer reserves the right to remove any content that violates these Terms without prior notice or explanation.

Simlancer offers a PRO membership tier that unlocks additional features such as portfolio photo uploads, enhanced profile visibility, and the ability to boost listings to Featured positions. By activating or receiving PRO status, you acknowledge that:

• PRO features are provided "as-is" and may be changed, limited, or discontinued at any time without compensation.
• PRO status is subject to compliance with these Terms at all times.
• Violation of these Terms may result in the immediate revocation of PRO status and permanent account ban, with no refund of any kind.
• Featured listings do not constitute an endorsement by Simlancer. Placement is a promotional tool only.
• Simlancer makes no representation that Featured listings will result in any particular number of views, inquiries, or transactions.

All platform design, branding, code, and original content produced by Simlancer are the exclusive property of Simlancer and may not be copied, reproduced, or used without express written permission.

Regarding content created by users and exchanged between users:

• Intellectual property arrangements for work produced under a freelance agreement are solely a matter between the Freelancer and the Client. Simlancer is not party to any such agreement.
• Freelancers retain the right to include completed work in their Simlancer portfolio unless a written confidentiality agreement with the Client states otherwise.
• You must not infringe on the intellectual property rights of Linden Lab, other Second Life creators, or any third party in your listings or portfolio.

Simlancer maintains the right — and responsibility — to enforce these Terms to protect the integrity of the community. Enforcement may include, without limitation:

• Content removal — any listing, photo, comment, or profile section that violates these Terms may be removed at any time without notice.
• Account suspension — temporary restriction of account access pending review of a potential violation.
• Permanent ban — permanent, irreversible revocation of access to the Platform for severe or repeated violations. A banned user's public listings and content may be hidden or removed.

Violations that will result in an immediate permanent ban include, but are not limited to: posting nudity or explicit content, hate speech, racism, doxxing, harassing other users, creating fake reviews, attempting to scam other users via the Platform, or creating a duplicate account after a ban.

Moderation decisions are made at Simlancer's sole discretion. While we welcome reports from the community, we are not obligated to take any specific action or provide explanations for enforcement decisions. There is no formal appeals process; however, users who believe a ban was issued in error may contact us once via the in-world notecard channel listed in Section 15.

Simlancer is not responsible for moderating behavior or transactions that occur outside the Platform, including inside Second Life.

The Simlancer Platform is provided "as-is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, availability, or non-infringement.

To the maximum extent permitted by applicable law, Simlancer, its founders, administrators, and collaborators shall not be liable for:

• Any direct, indirect, incidental, special, punitive, or consequential damages arising from your use of or inability to use the Platform.
• Financial losses resulting from transactions, scams, fraud, or disputes between users.
• Loss or corruption of data, listings, or account information.
• Downtime, platform errors, or interruptions to the Service.
• The conduct, content, or representations of any user on or off the Platform.
• Any actions or decisions made by Linden Lab or Second Life that affect your use of the Platform.

Your sole remedy for dissatisfaction with the Platform is to stop using it and, if applicable, delete your account.

Your use of the Platform is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights. By using Simlancer, you consent to data practices described in the Privacy Policy.

Simlancer collects only the data necessary to operate the Platform, including your Second Life avatar name, avatar image (fetched from Linden Lab's public API), and account credentials. We do not sell your personal data to third parties.

You may request the deletion of your account and associated data by contacting us in-world via the channel listed in Section 15.

You may stop using Simlancer at any time. You may request account deletion by contacting support.

Simlancer may terminate or suspend your access at any time, for any reason, with or without notice. Upon termination:

• Your right to use the Platform ends immediately.
• Sections covering Limitation of Liability, Intellectual Property, and Disclaimers survive termination and remain in effect.
• Simlancer may retain certain data as required by law or for legitimate operational purposes, as described in the Privacy Policy.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or your use of the Platform shall be resolved through good-faith negotiation in the first instance.

If resolution cannot be reached informally, disputes shall be submitted to the jurisdiction of the competent courts. You agree that Simlancer's failure to enforce any provision of these Terms does not constitute a waiver of that provision.
